Medical Malpractice
Approximately 44,000 people die in the United States each year due, in part, to medical malpractice and over 98,000 die worldwide. More people die every year from doctors who fail to provide the appropriate level of care, then from guns, AIDS, breast cancer or highway accidents.

Workers' Compensation
We work closely with a handful of legislators who are compassionate and understanding to the plight of the injured worker. We fight in the courts and in congress for our clients. We represent injured employees regardless of the type of employment or type of accident.

Product Liability
When a product is brought to market, everyone in the "supply chain" has a duty to provide a reasonably safe product when used as intended. When an individual is injured or dies because of a hazardous or defective product, the manufacturers or suppliers can be held liable for failing in their duty - this is the foundation for product liability claims.

Car Accidents
It is estimated that every ten seconds someone in the United States is involved in an automobile accident. A recent study has revealed that individuals represented by quality legal counsel receive substantially higher monetary recovery from their car accident claim than those who represent themselves. At Rosen and Rosen, we can support your claim by analyzing the accident and evidence to build the most effective case possible.

Pharmaceutical Negligence
It can be difficult to determine exactly what the long-term side effects of a particular drug or medication will be. However, sometimes drugs are rushed to market without adequate testing. Prescription medications may be heavily advertised and improperly prescribed. Unfortunately, in most instances people have to suffer injury or death before a pharmaceutical drug is recalled.

Vioxx Claims
Vioxx, the popular arthritis drug manufactured by Merck & Co., was removed from the market September 30, 2004. Vioxx has been cited for raising a patient's risk of heart attack and stroke. In addition to heart attacks and strokes, Vioxx has also been associated with several other life-threatening side effects, including blood clots, angina and nonbacterial meningitis, severe intestinal damage, ulcerations and bleeding, and kidney damage.

Celebrex Claims
Health concerns about the use of Celebrex have been raised before. In the August 2001 edition of the medical journal JAMA (Journal of the American Medical Association), an article raised concerns about the drug’s impact on cardiovascular health. The FDA sent Pharmacia Corp. a “warning letter” indicating that Pfizer's advertising campaign minimized the potentially serious cardiovascular findings that were observed in drug trials.

Antidepressants Claims
Zoloft, Paxil, and Prozac all belong to a class of drugs known as Selective Serotonin Reuptake Inhibitors, or SSRIs. SSRIs have become notorious for their alleged ability to induce children / adolescents to violence and suicide, and numerous reports have emerged linking use of SSRIs directly to crime and suicide.

Prempro Claims
A federal study released July 9, 2002 found that long-term use of Prempro, a hugely popular menopause treatment, leads to increased risk of breast cancer, heart disease, and strokes. Other studies released since that time have demonstrated a risk between estrogen only hormone therapy and ovarian cancer, and have substantiated the findings of the WHI investigators.

Admiralty Law
Florida ranks number one in maritime injuries. The United States Admiralty and Maritime law presides over navigation and shipping, including waters; commerce; seamen; piracy; towage; wharves, piers, and docks; insurance; maritime liens; canals; and recreation. The laws that apply to vessel accidents on and off-shore are complex and encompass federal and state regulations, and may also be impacted by international treaties.

Wrongful Death
The majority of wrongful death suits involve vehicular accidents (automobile, ATV, motorcycle, tractor trailer, snowmobile, etc). Other types of wrongful death claims include public carriers (railroads, planes, buses and maritime disasters), defective products, medical malpractice, and pharmaceutical liability. Negligence is the common element in most wrongful death actions and an individual is generally negligent if their act or failure to act is unreasonable and results in another’s injury or death. Negligence can be the result of lack of attention, thoughtlessness, inadvertence, and mistakes.

Dog Bites
Almost 5 million people nationwide are attacked or bitten by dogs each year in the United States. According to the American Humane Association, more children suffer dog bite injuries than measles, mumps and whooping cough combined. Victims are entitled to compensation when another person's negligence is proven. Individuals who provoke a dog are not eligible for compensation under the law; however, children of a certain age may be determined to be incapable of provocation.

Motorcycle Accidents
Are you one the 16,000 people injured annually in a motorcycle accident? Have you lost a loved one in a motorcycle-related fatality? Statistically speaking, cyclists are three times more likely to be killed in an auto accident than the driver of an automobile. While most motorcycle injuries involve the spinal cord and extremities, head injuries cause the majority of deaths. Manufacturers, wholesalers, and retailers can be held liable for defective or dangerous products when a product liability claim is successfully litigated.

Slip and Fall
Slips and falls or trips and falls that occur because of a hazard or defect on another person's property are called “premises liability” claims. Regardless of how or why a person enters a property, owners have a responsibility to maintain their property and to warn people who enter the premises of any unsafe conditions. If property owners fail to notify of hazardous premises conditions, they may be held legally responsible or "liable" for injuries that occur on their property.

Employment Law
Have you have been treated differently by your employer because of your race, gender, religion, or membership in any protected class? If so, you have been discriminated against. Does your employer continuously requires you to work additional hours and does not pay you over-time compensation? If so you are entitled to seek payment of those monies plus penalties under Federal and State laws. The Civil Rights Act of 1964, the Americans with Disabilities in Employment Act, and other federal and state laws protect individuals against employment discrimination by employers.
